La demanda se rechazó porque el demandante no subsanó las deficiencias argumentativas advertidas en el auto de inadmisión, y porque el nuevo cargo propuesto no satisfizo los presupuestos de especificidad, certeza, ni suficiencia exigidas.
La Sala Plena de la Corporación encontró que el actor e incurrió en una falta de motivación que le impidió emitir un pronunciamiento de fondo y, por ello, decidió RECHAZAR, por improcedente, el recurso impetrado.

- Primero. RECHAZAR, por improcedente, el recurso de súplica interpuesto por el ciudadano Saúl Garzón Rivera en contra del auto de 30 de noviembre de 2022 que rechazó la demanda de inconstitucionalidad en contra del artículo 708 (parcial) del Decreto 624 de 1989, "[p]or el cual se expide el Estatuto Tributario de los impuestos administrados por la Dirección General de Impuestos Nacionales".
- Segundo. Contra esta providencia no procede recurso alguno.
- Tercero. Ejecutoriada esta decisión, archívese el expediente.
